1 Acceptance of Terms

By creating an account, registering an organization, or utilizing any features of MarkuzAI, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with any part of these terms, you are prohibited from using the platform.

We reserve the right to revise or modify these terms at any time. Any changes will be indicated by updating the "Last updated" date. Your continued use of the platform after updates indicates consent.

2 Accounts & Registration

To access the communication and messaging features, you must register as an organization administrator or receive an invite link from an active organization admin:

• You agree to provide true, accurate, current, and complete registration details.
• You are responsible for maintaining the confidentiality of your account credentials and system SMTP configuration.
• You must immediately notify us of any unauthorized use or security breaches regarding your workspace.

3 Service Limits & Plan Specifications

MarkuzAI operates on a multi-tier subscription plan system. Each plan imposes specific limits on:

• Total number of branches/locations under a single organization.
• Total number of registered users and support agents.
• Daily, weekly, or monthly message sending caps for emails and WhatsApp notifications.

Our system checks limits before executing broadcast commands. Exceeding assigned plan limitations will restrict sending capabilities until the quota resets or the subscription is upgraded.

4 Acceptable Use Policy

You agree not to use MarkuzAI to:

• Send unsolicited bulk emails (spam) or messages violating global regulations (such as the CAN-SPAM Act).
• Impersonate any person or entity, or spoof email/sender domains that you do not own or have authorization to use.
• Distribute spyware, adware, viruses, or other malicious payloads.
• Bypass or attempt to circumvent system limit validation or multi-guard authentication.

5 Payments, Billing & Invoicing

Subscriptions are billed on a recurring cycle (monthly or yearly) depending on the selected plan.

• Payments are processed securely via integrated gateways (e.g. Razorpay).
• Billing issues, checkout redirections, or payment callback failures must be reported directly to our support channel.
• Invoices are generated automatically upon successful transactions and are available for download within your dashboard.

6 Limitation of Liability & Warranties

MarkuzAI is provided "as is" and "as available", without warranty of any kind, express or implied.

We do not guarantee that the services will be completely uninterrupted, secure, or free from server-side blocks imposed by external mail/message platforms (such as Zoho, Gmail, or Meta).

In no event shall MarkuzAI or its developers be liable for any direct, indirect, incidental, or consequential damages resulting from loss of database records, failed message delivery, or suspended server IPs.

7 Governing Law

These terms shall be governed, construed, and enforced in accordance with local regulations, without regard to its conflict of law provisions.
